Part One of Montesquieu's Idea of Justice comprises a survey of the currency in philosophical, ethical and aesthetic debate during the second half of the 17th century of the terms rapport and convenance, which are central to the enigmatic definition given to justice by Mon tesquieu in Lettres Persanes LXXXllI. In this survey, attention is concen trated on the way in which the connotations of these terms fluctuate with the divergent development of the methodological and speculative outgrowths of Cartesian ism (...) into two schools of thought, materialist and idealist, often widely at variance in their views of the nature and orga nization of the universe. In Part Two, Montesquieu's definition of justice is set against this background, whose doctrinal conflicts, because of the characteristic as sociations of its key terms, it may be taken to reflect, just as it may be held to epitomize, by virtue of its elaboration in the opening chapter of De l' Esprit des Lois and its close terminological affinities with the defini tion of law there given, an undoubtedly related conflict between the implications of causal determinism and the aspirations of idealist meta physics surviving at the heart of Montesquieu's outlook, and, remaining unresolved, often said to impair the coherence if not the validity of his theory of society. Xenotransplantation - the transfer of living tissue between species - has long been heralded as a potential solution to the severe organ shortage crisis experienced by the United Kingdom and other 'developed' nations. However, the significant risks which accompany this biotechnology led the United Kingdom to adopt a cautious approach to its regulation, with the establishment of a non-departmental public body - UKXIRA - to oversee the development of this technology on a national basis. In December 2006 UKXIRA was quietly (...) disbanded and replaced with revised guidance, which entrusts the regulation of xenotransplantation largely to research ethics committees. In this article we seek to problematize this new regulatory framework, arguing that specialist expertise and national oversight are necessary components of an adequate regulatory framework for a biotechnology which poses new orders of risk, challenges the adequacy of traditional understandings of autonomy and consent, and raises significant animal welfare concerns. We argue for a more considered and holistic approach, based on adequate consultation, to regulating biotechnological developments in the United Kingdom. (shrink)

As características do teletrabalho podem contribuir tanto para o aumento quanto para a diminuição do estresse do trabalhador. Este estudo buscou identificar os preditores de estresse, em termos de vantagens e desvantagens do teletrabalho, recursos e demandas psicossociais relacionados ao trabalho e interação trabalho-família, entre servidores da Justiça Federal do Rio Grande do Sul que desenvolvem teletrabalho. Os 130 participantes responderam o questionário de dados demográficos e laborais, escala de estresse percebido, vantagens e desvantagens do teletrabalho, recursos-demandas do trabalho e (...) interação trabalho-família. Análise de regressão linear múltipla identificou um modelo preditivo de estresse composto pelas variáveis de interações trabalho-família e família-trabalho negativas, autoeficácia e sobrecarga. Os resultados apontam fatores de risco e proteção para o estresse entre teletrabalhadores. Ressalta-se a necessidade de legislação laboral nacional que regulamente o teletrabalho, de forma a configurá-lo de maneira mais concreta, permitindo ações visando à saúde dos trabalhadores. In States of Knowledge, Sheila Jasanoff argues that we gain explanatory power by thinking of natural and social orders as being produced together, but she and her volume contributors do not yet offer a theory of the coproduction of scientific knowledge and social order. This article uses Mary Douglas’s cultural theory to identify four recurring states of knowledge and to specify political–cultural conditions for the coproduction of scientific knowledge, social order, and scientific, cultural, and policy change. Agonistic Democracy explores how theoretical concepts from agonistic democracy can inform institutional design in order to mediate conflict in multicultural, pluralist societies. Drawing on the work of Foucault, Nietzsche, Schmitt, and Arendt, Marie Paxton outlines the importance of their themes of public contestation, contingency and necessary interdependency for contemporary agonistic thinkers. Paxton delineates three distinct approaches to agonistic democracy: David Owen's perfectionist agonism, Mouffe's adversarial agonism, and William Connolly and James Tully's inclusive agonism. This paper analyzes what it means for philosophy of science to be normative. It argues that normativity is a multifaceted phenomenon rather than a general feature that a philosophical theory either has or lacks. It analyzes the normativity of philosophy of science by articulating three ways in which a philosophical theory can be normative. Methodological normativity arises from normative assumptions that philosophers make when they select, interpret, evaluate, and mutually adjust relevant empirical information, on which they base their philosophical theories. (...) Object normativity emerges from the fact that the object of philosophical theorizing can itself be normative, such as when philosophers discuss epistemic norms in science. Metanormativity arises from the kind of claims that a philosophical theory contains, such as normative claims about science as it should be. Distinguishing these three kinds of normativity gives rise to a nuanced and illuminating view of how philosophy of science can be normative. (shrink)

Discussion of Wittgenstein's Tractatus is currently dominated by two opposing interpretations of the work: a metaphysical or realist reading and the 'resolute' reading of Diamond and Conant. Marie McGinn's principal aim in this book is to develop an alternative interpretative line, which rejects the idea, central to the metaphysical reading, that Wittgenstein sets out to ground the logic of our language in features of an independently constituted reality, but which allows that he aims to provide positive philosophical insights into (...) how language functions. McGinn takes as a guiding principle the idea that we should see Wittgenstein's early work as an attempt to eschew philosophical theory and to allow language itself to reveal how it functions. By this account, the aim of the work is to elucidate what language itself makes clear, namely, what is essential to its capacity to express thoughts that are true or false. However, the early Wittgenstein undertakes this descriptive project in the grip of a set of preconceptions concerning the essence of language that determine both how he conceives the problem and the approach he takes to the task of clarification. Nevertheless, the Tractatus contains philosophical insights, achieved despite his early preconceptions, that form the foundation of his later philosophy. -/- The anti-metaphysical interpretation that is presented includes a novel reading of the problematic opening sections of the Tractatus, in which the apparently metaphysical status of Wittgenstein's remarks is shown to be an illusion. The book includes a discussion of the philosophical background to the Tractatus, a comprehensive interpretation of Wittgenstein's early views of logic and language, and an interpretation of the remarks on solipsism. The final chapter is a discussion of the relation between the early and the later philosophy that articulates the fundamental shift in Wittgenstein's approach to the task of understanding how language functions and reveal the still more fundamental continuity in his conception of his philosophical task. In dialogue with the most famous myth for the origin of different languages - The Tower of Babel - A Psychoanalytic Exploration on Sameness and Otherness: Beyond Babel provides a series of timely reflections on the themes of sameness and otherness from a contemporary psychoanalytic perspective. How are we dealing with communication and its difficulties, the confusion of tongues and loss of common ground within a European context today? Can we move beyond Babel? Confusion and feared loss of shared values (...) and identity are a major part of the daily work of psychoanalytic psychotherapists. Bringing together an international range psychoanalytic practitioners and researchers, the book is divided into six parts and covers an array of resonant topics, including: language and translation; cultural identity; families and children; the cyber world; the psychotherapeutic process; and migration. Whereas the quest for unity, which underpins the myth of Babel, leads to mystification, simplification and the exclusion of people or things, multilingual communities necessitate mutual understanding through dialogue. This book examines those factors which further or threaten communication, aiming not to reduce but to gain complexity. It suggests that diversification enriches communication and that, by relating to others, we can create something new. As opposed to cultural and linguistic homogeneity, Babel is not only a metaphor for mangled communication, alienation, and distraction, it is also about the acceptance or rejection of differences between self and other. Descartes claims that the passions of the soul are “all in their nature good” even though they exaggerate the value of their objects, have the potential to deceive us, and often mislead us. What, then, can he mean by this? In this paper, I argue that these effects of the passions are only problematic when we incorrectly take their goodness to consist in their informing us of harms and benefits to the mind-body composite. Instead, the passions are good in their (...) motivational function, which they carry out by representing objects and situations as having various properties and thereby appearing to be “reasons of goodness.” Further, I argue that the main way in which the passions are problematic is merely an occasional physiological byproduct of a well- functioning system. I show, therefore, that the passions’ motivational function, representationality, and accompanying physiology are all significant and interrelated aspects of their goodness. (shrink)

The Greek and Roman atomistic tradition (whose most famous representatives are Democritus, Epicurus and Lucretius), defends radical and immanentist ideas about the discovery of technologies in human societies. The appearance of new technologies, insofar as it is due to the satisfaction of human needs and derives from natural necessity, reveals that human work is in some way a natural process. Consequently, human beings do not need any kind of Promethean intervention, which would provide them with new skills and technologies. However, (...) the Epicurean tradition, as evidenced by several texts (especially in Lucretius), echoes the mythological figure of Prometheus, in showing that human beings, through their discoveries, are independent from the gods. Epicurus himself, in Lucretius’ De rerum natura, embodies, like Prometheus, the ideal of human emancipation from superstitious representations of the gods. It does not mean, however, that work and technical discoveries are the best means of emancipation: for Epicurus and his followers, philosophy itself remains the safest way to tranquillity and freedom. Health‐care and public sector institutions are high‐risk settings for workplace bullying. Despite growing acknowledgement of the scale and consequence of this pervasive problem, there has been little critical examination of the institutional power dynamics that enable bullying. In the aftermath of large‐scale failures in care standards in public sector healthcare institutions, which were characterised by managerial bullying, attention to the nexus between bullying, power and institutional failures is warranted. In this study, employing Foucault's framework of power, we illuminate bullying as (...) a feature of structures of power and knowledge in public sector institutions. Our analysis draws upon the experiences of a large sample (n = 3345) of workers in Australian public sector agencies – the type with which most nurses in the public setting will be familiar. In foregrounding these power dynamics, we provide further insight into how cultures that are antithetical to institutional missions can arise and seek to broaden the debate on the dynamics of care failures within public sector institutions. Understanding the practices of power in public sector institutions, particularly in the context of ongoing reform, has important implications for nursing. (shrink)

Contemporary liberal theologians have argued (...) that this dilemma is [End Page 97] entirely too stark, too eliminative of the creative possibilities of revisionism. Liberal theology has wanted to revise and reinterpret Christian faith in conformity with history, reason, a scientific worldview, and a sophisticated grasp of the significance of symbol, analogy, and metaphor in the lives of religious practitioners. Eliminating both supernaturalism and anthropomorphism, liberal theology would make Christianity more intellectually tenable, rescuing it from the literalist hands of fundamentalists, without collapsing it into the equally literalist arms of atheism.The extreme difficulty of evading the either-or dilemma of choosing either fundamentalism or atheism landed liberal theology in a catch-22: either it rejected the intellectually untenable elements of belief, in which case it eliminated just those beliefs that constituted its appeal to popular piety, or it retained certain supernaturalistic and anthropomorphic beliefs, understood as “symbolic,” in which case it forfeited intellectual intelligibility and any appeal to sophisticated moderns. The first version is far too weakened for ordinary American Christians, and the second is still too religious for the masters of suspicion and their followers.It is for this reason that the history of American religious thought reveals a grave irony that complicates the hopes of pragmatic historicists, the protagonists of this superbly clear and rich, deep dive into authors that most readers of this journal will have read, but perhaps not have synthesized as thoroughly as has Demian Wheeler. That irony, as Wheeler knows, is that the more intellectual changes pragmatic historicists make to traditional Christian belief, the more they help to make unbelief viable. The question then arises as to whether pragmatic historicism is simply a half-way house on the road to an atheistic destination. Or, if the word “atheism” sounds too old-fashioned, like something that went out with steamships and girdles, then “agnosticism.” Or, if “agnosticism” still smacks too much of stale debates, why not “pantheism,” as recently revived by Mary-Jane Rubenstein?The detailed development, the verbal bravura, and the measured knowledge in this book are astonishingly impressive. Wheeler’s initial thesis is that liberal theology, particularly of the early Chicago School, and American pragmatism, particularly C. S. Peirce, William James, and John Dewey, provide important resources for meeting the challenges posed by the rise of historical consciousness. Sheila Davaney has designated this tradition “pragmatic historicism,” and Wheeler aims to show its compelling import for the future of theology itself. A good deal of the book is devoted to exposition and defense of the views of: Ernst Troeltsch, James, Dewey, George Burman Foster, Shirley Jackson Case, Shailer Matthews, and Gerald Birney Smith, down to Delwin Brown, Sheila Davaney, and William Dean (Wheeler’s teachers at Iliff), along with Gordon [End Page 98] Kaufman and Sallie McFague. In the last chapter, Wheeler draws expertly on the theological views of Bernard Loomer, Michael Hogue, Donald Crosby, and Wesley Wildman. Such an all-star cast deserves to receive all the attention they can get. Wheeler’s occasional emendations come as glittering nuggets of constructive engagement. He does not simply call for a pragmatic historicist approach to theology, but he executes one as well, showing in more detail than his predecessors what it means for such topics as religious diversity (chapters 3 and 4), the nature of authority (chapter 5), the meaning of critical realism, fallibilism, and an altered correspondence theory of truth (chapters 6 and 7), and the doctrine of God (chapter 8). With the same exhaustive treatment that his doktorvater Gary Dorrien has devoted to liberal theology’s history and contemporary expressions, Wheeler carefully saves pragmatic historicism from relativism, expertly critiques all the leading theologians of the “inclusivist,” “exclusivist,” and “pluralist” theologies of religions, while arguing the superiority of his own “particularist” corrective to pluralistic... Personhood is ascribed on others, such that someone who is recognized to be a person is bestowed with certain civil rights and the right to decision making. A rising question is how severely brain-injured patients who regain consciousness can also regain their personhood. The case of patients with locked-in syndrome is illustrative in this matter. Upon restoration of consciousness, patients with LIS find themselves in a state of profound demolition of their bodily functions. From the third-person perspective, it can be (...) expected that LIS patients might experience a differential personal identity and may lose their status as persons. However, from the patients’ perspective, it is uncontested that they retain their personal identity and that they consider themselves to be persons. We here include results from a survey with patients with LIS aimed at identifying the primary expectations of patients for their care by non-medical professionals. Based on these first-hand reports, we argue that personhood in LIS is progressively regained as the widening circle of others recognizes them as persons. (shrink)

To test if dreams contain remote or never-experienced motor skills, we collected during 6 weeks dream reports from 15 paraplegics and 15 healthy subjects. In 9/10 subjects with spinal cord injury and in 5/5 with congenital paraplegia, voluntary leg movements were reported during dream, including feelings of walking , running , dancing , standing up , bicycling , and practicing sports . Paraplegia patients experienced walking dreams just as often as controls . There was no correlation between the frequency of (...) walking dreams and the duration of paraplegia. In contrast, patients were rarely paraplegic in dreams. Subjects who had never walked or stopped walking 4–64 years prior to this study still experience walking in their dreams, suggesting that a cerebral walking program, either genetic or more probably developed via mirror neurons is reactivated during sleep. This paper considers the terms used for designating parents in reports dealing with child protection, and explores the pragmatic impact of the reports’ extremely cautious choice of words. I test the hypothesis that, even if words are not argumentative in themselves, they can become argumentative in the context of a particular discourse. To this end, this paper develops a two-pronged analysis, combining lexical description with quantitative as well as qualitative methodologies. The findings suggest that lexis is argumentative not only because (...) of its paradigmatic dimension, but also because of its syntagmatic dimension. Flax seedlings grown in the absence of environmental stimuli, stresses and injuries do not form epidermal meristems in their hypocotyls. Such meristems do form when the stimuli are combined with a transient depletion of calcium. These stimuli include the “manipulation stimulus” resulting from transferring the seedlings from germination to growth conditions. If, after a stimulus, calcium depletion is delayed, meristem production is also delayed; in other words, the meristem-production instruction can be memorised. Memorisation includes both storage and recall of information. (...) Here, we focus on information recall. We show that if the first transient calcium depletion is followed by a second transient depletion there is a new round of meristem production. We also show that if an excess of calcium follows calcium depletion, meristem production is blocked; but if the excess of calcium is in turn followed by another calcium depletion, again there is a new round of meristem production. The same stored information can thus be recalled repeatedly . We describe a conceptual model that takes into account these findings. (shrink)
